We are really pleased to report that all Valpak ESOS customers have complied;
however, recent news suggests that not every business has picked up on the need
to address their obligations under the Energy Savings Opportunity Scheme (ESOS).
It has been suggested that around 30-40% of the 10,000 or so companies that should
have qualified and complied still haven’t done so. These companies will now face
enforcement action and fines of up to £50,000. The Environment Agency can use their
discretion when applying penalties, so it will be interesting to see who is actually
fined and how much they will have to pay out.
ESOS is now in the second compliance period and we are currently having discussions
with our customers about next steps. Some are taking the view that even though the second period qualification date isn’t
until December 2018 why rush everything in the last year when you can start taking
action now. Others are considering
delaying action as it is uncertain whether they’ll meet the qualification thresholds.
Government consultation – reforming the business energy efficiency tax landscape
To complicate matters, at the end of last year the government carried out a consultation
on reforming the business energy efficiency tax landscape. This covered a raft of
mechanisms which currently impact upon businesses in terms of energy and carbon
emission reporting and charges. Included within this review were both ESOS and the Carbon Reduction Commitment (CRC), which have had some obvious overlaps. This has
added some uncertainty over the future of the schemes.
We wait to see what is announced
in March 2016.
